Terms of Service
Welcome to use the services provided by Moimobi Cloud Phone Platform (https://www.moimobi.com, hereinafter referred to as "Platform")! Moimobi Technology Pte. Ltd. (hereinafter referred to as "we" or "Moimobi") has formulated these "Terms of Service" (hereinafter referred to as "these Terms") to regulate your use of the Platform. Before using Moimobi services, please carefully read and understand these Terms. Using Moimobi services means you have fully understood and agreed to these Terms.
1. Service Content
Moimobi provides cloud phone services, including but not limited to cloud application running, data storage, offline hosting and value-added services (such as high-performance cloud phone models). The specific service content is subject to what the platform actually provides.
2. User Eligibility
You must be at least 18 years old or use this service with the consent of a legal guardian.
You need to provide true, accurate, and complete registration information and update it in a timely manner.
You may not use the account for illegal or unauthorized purposes.
3. User Conduct Standards
When using Moimobi services, you agree to:
Comply with all applicable laws and regulations and these Terms;
Not upload or disseminate illegal, obscene, defamatory or infringing content;
Not interfere with or disrupt platform services (such as malicious attacks, resource abuse);
Not access other people's accounts or data without authorization;
Not use the platform for illegal activities.
Be responsible for content you upload or generate through the platform and ensure its legality.
4. Intellectual Property
The intellectual property rights of the platform and its content belong to Moimobi or its licensors.
For content you upload through the platform, the intellectual property rights belong to you or the legal rights holder, but you grant Moimobi a non-exclusive, transferable global license to use it to provide and optimize services.
Without written permission from Moimobi, you may not copy, modify, or disseminate platform content.
5. Service Fees and Payment
Some services may require payment of fees, subject to the charging standards published by the platform.
You should pay fees on time, and overdue payments may result in service suspension or termination.
Unless otherwise provided by laws and regulations or these Terms, fees are non-refundable once paid.
6. Service Interruption and Termination
We may interrupt services due to maintenance, upgrades or force majeure (such as network failures, natural disasters) and will try to notify in advance.
If you violate these Terms, we may suspend or terminate services to you.
You can terminate services at any time through "My-Settings-Account Cancellation", and related data will be processed according to the "Privacy Policy" after cancellation.
7. Disclaimer
Moimobi provides services "as is" and does not guarantee that services are completely uninterrupted or error-free.
We are not responsible for service unavailability, data loss, etc. caused by force majeure or non-Moimobi reasons.
You bear the risk of third-party services or content accessed through the platform, and Moimobi is not responsible for third-party actions.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Moimobi is not liable for indirect, incidental, special, consequential or punitive damages (including but not limited to loss of profits, data loss) caused by using the services.
If Moimobi needs to bear liability, the compensation amount shall not exceed the total service fees you paid to Moimobi in the past 12 months.
You agree to bear the risk of loss caused by failure to back up data yourself, and Moimobi is not responsible for loss or damage of user data unless explicitly agreed.
9. Service Level Agreement (SLA)
Moimobi is committed to providing highly available cloud phone services with a target availability of 99.9% (calculated monthly). Planned or uncontrollable interruptions due to maintenance, upgrades or force majeure are not included in availability calculations.
If the above availability standards are not met, you can apply for compensation through support@moimobi.com. Compensation is mainly in the form of service credits or extended service periods, subject to policies published by the platform.
SLA does not apply to free services or service unavailability caused by user behavior (such as violating these Terms).
10. User Content Backup Responsibility
You are responsible for regularly backing up content stored or generated through Moimobi services (such as application data, configuration files).
Moimobi may provide data backup functions, but does not guarantee the integrity or availability of backups. It is recommended that you maintain redundant copies of important data yourself.
Moimobi is not responsible for data loss caused by users' failure to back up.
11. Applicable Law and Dispute Resolution
The interpretation, validity and dispute resolution of these Terms are governed by Singapore law.
For disputes arising from these Terms, the parties should first resolve them through friendly consultation; if consultation fails, either party may file a lawsuit in a court with jurisdiction in Singapore.
12. Terms Updates
We may update these Terms from time to time and will notify you in prominent positions on the platform after updates. Continued use of services means you agree to the updated Terms.
